Overview
Jinxter Labs is the trading name of Rowena Simon Ruiter, a sole proprietor. These terms cover your use of Jinxter Labs ("we", "us") apps, including SFX Showtime Pro, KaraYou and KaraHome, our website, and any JinxterLabs account. By creating an account, downloading an app, or completing a purchase, you agree to these terms. Our Privacy Policy explains how we handle your personal data.
If you're a consumer, nothing in these terms takes away the rights that consumer protection law in your country gives you.
Accounts
A JinxterLabs account is required to buy a license and to manage licenses, devices, and subscriptions from the dashboard. One account works across every Jinxter Labs app. You're responsible for keeping your password secure and for activity under your account. Provide an accurate email address - it's how we deliver license keys, verification links, and account notices. You must be old enough in your country to enter into this agreement, or have a parent/guardian's consent to do so.
Licenses & Purchases
Buying a license grants you a personal, non-exclusive, non-transferable right to install and use the app on the number of devices your license permits. You're not buying the software itself or any copy of its source code - all rights not expressly granted are reserved.
Checkout is run by Paddle.com Market Limited, our payment processor and merchant of record: you buy from Paddle, which resells our apps. Paddle handles billing, invoicing, tax, and refunds under Paddle's Buyer Terms (see also our Refund Policy). The price, including any tax, and the billing period are shown at checkout before you pay. Subscription plans renew automatically at the end of each billing period until cancelled; you can cancel at any time from your account dashboard, and you keep access through the end of the period you already paid for.
License keys are tied to your account and to the devices you activate them on. Don't share, sell, or publish your license key, and don't attempt to bypass or disable license or trial enforcement.
Free Trials
Where offered, free trials run for a fixed period from first use on a given device. Reinstalling the app or creating a new account doesn't extend or restart a trial that's already been used on that device.
Music, Videos & Other Content
Our apps play content that you choose: videos from YouTube, and your own media files. We don't own, supply, or license that content, and buying our apps doesn't give you any rights to it.
- Public performance: playing music or karaoke videos in public, such as at a bar, venue, or ticketed event, usually requires licenses from music rights organisations in your country. If you use our apps for events, you're responsible for holding those licenses and for having the right to play the content you use.
- YouTube: KaraYou and KaraHome search and play YouTube videos in YouTube's own player. When you use these features, you also agree to YouTube's Terms of Service. YouTube can change or remove videos at any time, and we're not responsible for the content of any video.
Hosting Guests
KaraYou Live Requests and KaraHome guest connections let your guests send you their names and song requests. Some of that data, such as KaraYou venue member lists and KaraHome guest lists, is kept on your own computer, where you control it. You're responsible for how you use it and for following any privacy laws that apply to you as a host; please use it only to run your show, and honour guests' requests to remove them.
Acceptable Use
- Don't reverse engineer, decompile, or disassemble an app beyond what's expressly permitted by law.
- Don't use an app or its services to violate any law, or to infringe anyone else's rights.
- Don't attempt to gain unauthorized access to another account, our license server, or KaraYou's live request queues.
- Don't use KaraYou Live Requests or KaraHome guest connections to submit abusive, harassing, or unlawful content.
Disclaimer & Limitation of Liability
Our apps and services are provided "as is," without warranties of any kind, express or implied, to the extent permitted by law. We don't guarantee they'll be uninterrupted, error-free, or fit for a particular purpose. To the extent permitted by law, Jinxter Labs isn't liable for indirect, incidental, or consequential damages arising from your use of an app or service; our total liability for any claim is limited to the amount you paid for the app or service concerned in the 12 months before the claim arose.
Nothing in these terms excludes or limits liability that can't be excluded or limited by law, such as liability for death or personal injury caused by negligence, or for fraud, or your statutory rights as a consumer.
Termination
You can stop using an app at any time, and you can ask us to delete your account by emailing us from its address. We may suspend or terminate an account, or deactivate a license, that violates these terms, including license-sharing or attempts to bypass license enforcement. Sections that by their nature should survive termination (e.g. limitation of liability) continue to apply.
Changes to These Terms
We may update these terms as our apps and services change. Every change updates the "Last updated" date at the top of this page, and we'll email account holders about material changes before they take effect. If you don't agree to a change, you can stop using the apps and cancel any subscription before it applies; continuing to use them afterwards means you accept the updated terms.
Governing Law
These terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-law principles, and disputes may be brought before the courts of the Philippines. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there.
